Terms of Service

These terms govern your access to and use of GovForms AI Receptionist. By creating an account or using the service, you agree to these terms.

1. Agreement

These Terms of Service (“Terms”) are a binding agreement between you and GovForms AI Receptionist (“we”, “us”, “our”) for use of our website, APIs, customer dashboard, embeddable widget, and related services (collectively, the “Service”).

If you use the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. The Service

GovForms AI Receptionist helps Australian small businesses scan their website and documents, build a structured knowledge base, and answer customer enquiries using AI via web chat, browser voice, and optional live phone answering.

The Service includes free features (such as scanning and browser voice simulation) and paid features (such as subscription access to live telephony). Feature availability may change as we develop the product.

3. Accounts and eligibility

To use the Service you must:

  • be at least 18 years old;
  • provide accurate registration information;
  • keep your login credentials secure;
  • promptly notify us of unauthorised account access.

You are responsible for all activity under your account. Each business account is for a single business entity unless we agree otherwise in writing.

4. Acceptable use

You must not use the Service to:

  • violate any applicable law or third-party rights;
  • upload, crawl, or distribute unlawful, misleading, harassing, or infringing content;
  • attempt to bypass security, probe systems, or interfere with other customers;
  • use the AI to provide regulated professional advice (such as legal, medical, or financial advice) without appropriate human oversight and disclosures;
  • resell or sublicense the Service without our written consent;
  • send spam or automate abusive traffic through the widget or phone lines.

You are responsible for ensuring you have the right to provide website URLs and documents for processing, and for configuring call forwarding and telephony in compliance with applicable telecommunications rules.

5. Your content and knowledge base

You retain ownership of content you submit (websites, documents, and manual knowledge edits). You grant us a non-exclusive licence to use, store, process, and display that content solely to provide and improve the Service for your account.

You are responsible for the accuracy of your knowledge base and for reviewing AI-extracted facts before relying on them for customer interactions. Automated extraction may be incomplete or incorrect; always verify critical business information.

6. AI limitations

The Service uses artificial intelligence. AI outputs may be incorrect, incomplete, or inappropriate in edge cases despite grounding and safety measures.

The Service is not a substitute for human staff where human judgment, emergency response, or regulated advice is required. You must provide your customers with a way to reach a human when needed and comply with any industry-specific obligations that apply to your business.

7. Subscriptions and billing

Paid features are billed through Stripe. Prices are shown in Australian dollars unless stated otherwise. By starting a subscription or trial, you authorise us and Stripe to charge your payment method according to the plan you select.

  • Trial and subscription terms (including price, renewal, and trial length) are presented at checkout and in your dashboard.
  • You may cancel in accordance with the billing flows we provide; cancellation stops future charges but does not entitle you to a refund for periods already billed unless required by law.
  • We may change pricing for new subscriptions with reasonable notice; existing subscriptions are handled according to the notice we provide at the time of change.

8. Telephony and phone numbers

When you subscribe to live call answering, we may provision a dedicated phone number through a third-party telephony provider. Number availability, porting, and regulatory requirements (including Australian numbering rules) may affect provisioning.

Unused numbers may be released after the period stated in your dashboard or onboarding materials. You are responsible for updating your public listings and call forwarding when a number changes or is released.

9. Privacy

Our collection and use of personal information is described in our Privacy Policy, which forms part of these Terms.

10. Our intellectual property

We own the Service, software, branding, and documentation. These Terms do not grant you any rights to our trademarks or underlying technology except the limited right to use the Service as intended during your subscription or free tier access.

11. Availability and changes

We aim for reliable service but do not guarantee uninterrupted or error-free operation. Maintenance, third-party outages, and factors outside our control may affect availability.

We may modify, suspend, or discontinue features with reasonable notice where practicable. If we discontinue the Service entirely, we will provide notice and a reasonable opportunity to export your knowledge base where technically feasible.

12. Disclaimers

To the maximum extent permitted by Australian Consumer Law and other applicable law, the Service is provided “as is”. Except for non-excludable guarantees, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.

13. Limitation of liability

Nothing in these Terms limits rights you may have under the Australian Consumer Law that cannot be excluded.

To the extent permitted by law, our total liability for any claim arising from or relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the claim, or (b) AUD $100.

We are not liable for indirect, incidental, special, or consequential loss, or for loss of profits, revenue, data, or goodwill, except where such liability cannot be excluded by law.

14. Indemnity

You indemnify us against claims, losses, and expenses arising from your content, your use of the Service, your breach of these Terms, or your violation of any law or third-party right, except to the extent caused by our wrongful act or omission.

15. Termination

You may delete your account at any time through the dashboard. We may suspend or terminate access if you breach these Terms, create security risk, or fail to pay amounts due.

On termination, your right to use the Service ends. Provisions that by nature should survive (including liability limits, indemnity, and governing law) continue to apply.

16. Governing law

These Terms are governed by the laws of New South Wales, Australia. The courts of New South Wales have non-exclusive jurisdiction, subject to any mandatory consumer protections in your state or territory.
